US Court Orders Freedom of Abrego Garcia from ICE Custody
A federal judge has ruled the immediate discharge of Kilmar Abrego Garcia from detention by ICE, finding his continued detainment is without legal authority.
"Since his return from wrongful imprisonment in El Salvador, he has been taken back into custody, again without legal justification," the judge stated in her order.
The case originates in a mistaken deportation to El Salvador in March, which US authorities later admitted was an mistake. Following his return to the United States to answer alien smuggling allegations, he was detained in immigration custody.
In her order, the judge noted that the government lacks a current deportation order, which prevents them from removing Mr. Abrego Garcia "at this juncture."
Background of the Legal Challenge
The legal proceedings involve disputed assertions. While the Trump administration argues that Abrego Garcia is a member of the MS-13 gang, he vehemently denies this claim.
He has also pleaded not guilty to the smuggling charges, which are part of a separate criminal case in Tennessee.
Conditions of Release
The court, who was overseeing his challenge to deportation in a federal court, ruled that he must now comply with the conditions of his release from jail in Tennessee. This decision effectively transfers his monitoring to the jurisdiction handling his criminal case.
This decision marks a significant turn in a complicated legal case featuring claims of wrongful detention and disputed gang affiliations.
